Owner retains full legal, possessor and access rights at any time especially upon emergencies, or if owner understand that tenant needs to be contacted in person. a. Conducting any kind of business (including childcare services) at the property is prohibited, except that any lawful business conducted at home by computer, mail, or telephone is permissible if customers, clients, patients, or other business associates do not come to your apartment for business purposes and we assent in writing to the proposed business operation. SECURITY DEPOSIT: A security deposit will secure the performance of the Occupants obligations. Owner may, but will not be obligated to, apply all portions of said deposit on account of Occupants obligations. The Security Deposit may be automatically refunded ten (1) days after termination of this lease unless Landlord determines there are damages or other deductions to be made resulting from actions of the guest. Said amounts shall be deducted from the Security Deposit and the remainder shall be refunded. RENTABILITY: Neither Owner nor Agent shall be liable for events beyond their control which may interfere with Occupant(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, or inclement weather. NO REBATE OR REFUND will be offered in these circumstances. a. The Lease shall not terminate as a result of off-site conditions beyond the control of the Landlord or as a result of inoperable appliances at the property. LANDLORDS RIGHT OF ENTRY: Landlord and Landlords agents shall have the right at all reasonable times during the term of this Agreement and any renewal thereof to enter the Premises for the purpose of inspecting the Premises and improvements thereon. And for the purposes of making any repairs, additions or alterations as may be deemed appropriate by Landlord for the preservation of the Premises or the building. Landlord and its agents shall further have the right to exhibit the Premises and to display the usual for sale, for rent or vacancy signs on the Premises. NOISE VIOLATION POLICY: Our noise violation policy is primarily concerned about noises coming from inside the unit. In this case, first offense will result in a warning from owner; second offense will result in a written warning notice including a penalty of $ 500 to be immediately taken as damage collected. If there are more than 2 noises violations or if the police department is called by neighbors, or owner, to control noises from this premise, the owner has the right to cancel the rental agreement resulting in immediate eviction of occupant and all guests as well as forfeiture of all amounts paid plus penalty of $ 500. Also, police fee is to be paid by occupant. Occupant agrees to respect the quite hours between 9PM-8AM. ILEGAL ACTIVITY: Premise may not be used for any activities in violation of local, state, or federal laws of Georgia, insurance rules and regulations. If owner observes any activity of suspicious nature on the part of occupant or any of his guests, the police will be informed, and the activity may be cause for immediate termination of rental agreement with possible prosecution. It will also be resulting in immediate eviction of occupant and all guests as well as forfeiture of all amounts paid plus damage collected fine of $ 500 dollars. HOUSE RULES AND REGULATIONS: Occupant agrees to comply with all rules and regulations listed in this rental agreement, posted on the premises, or delivered to the occupant. USE OF PREMISES: Tenant shall only use the Premises as a residence. SMOKING POLICY: Smoking is not permitted inside the premises at any time. In addition, we request not to touch or attempt to remove our smoke detectors on any circumstances. If repair is necessary, owners must be informed. If smoking is necessary, we strongly suggest you do it outside ONLY. Also, note that you must keep the doors and windows closed to avoid smoking from coming into the premises otherwise, a fee of $ 750.00 will be collected and used to deodorize the entire unit. We must keep the premise odor free in consideration to our future tenants. The tenant will, at its sole expense, keep that part of the Premises that he or she occupies in good and sanitary condition and repair during the term of this Agreement and any renewal thereof. Make every reasonable effort to conserve the use of utilities supplied and paid for by the Landlord and shall not waste the same. Not deliberately or negligently destroy, deface, damage, impair, or remove any part of the Premises or knowingly permit any person to do so. Conduct himself or herself and require other persons on the Premises with his or her consent to conduct themselves, in a manner that will not disturb his or her neighbors peaceful enjoyment of the Premises. NOISE ORDINANCE City code Sec. 074-131. We are in a family friendly neighborhood and respect the area and all of our neighbors. We expect all of our guests to do the same. Quiet Hours are in effect from 9pm-8am. Not leave windows or doors in an open position during any inclement weather Place trash/waste in sealed plastic bags and use bins provided for trash and recycling. Keep bins in designated locations and move bins to the curb in time for pick-up according to schedule provided by the Landlord. Reimburse the Landlord for any fine or fee paid by the Landlord as a result of any Resident action or inaction to comply with any law or ordinance. HAZARDOUS MATERIALS: Tenant shall not keep on the Premises any item of a dangerous, flammable, or explosive character that might unreasonably increase the danger of fire or explosion on the Premises or that might be considered hazardous or extra hazardous by any responsible insurance company. WATER LEAKS: Tenant is to notify the Landlord immediately if Tenant notices any running water in the faucets in the kitchen, bathroom-sink, bathtub, washing machine or any other faucets. If the toilet is running and does not shut off properly, Tenant is to notify Landlord immediately. If Tenandamagenot notify Landlord of any water leaks and it is determined that the water bill is in excess because of this leak, Tenant will be responsible financially for paying the difference in the water bill plus paying for any damages associated with the water leak. ALTERATIONS: You must use customary diligence in maintaining the apartment and not damaging or littering the common areas. Unless authorized by statute or by us in writing, you must not perform any repairs, painting, electrical changes, or otherwise alter our property. Tenants must comply with All HOA rules and regulations. Tenant shall notify the police and Landlord of any unlawful purpose including but not limited to the sale, use or possession of illegal drugs on or around the leased premises. Tenants must report any malfunction with smoke detectors immediately to landlord. The tenant agrees not to dismantle or take any action to interfere with the operation of any smoke detector installed on the leased premises. Absolutely no hazardous materials are permitted to be in or around the leased premises at any time. The tenant shall notify landlord of any pest control problem. Damages - Please, report any accidental damage or breakages in a timely manner, especially before check-out. Failure to report them will likely result in a penalty deduction from the security deposit. Damages exceeding the security deposit amount must be paid by guests.
